Advancing Excellence: Global Perspectives on Construction Disputes Resolution

DG Jones & Partners recently had the privilege of being the Platinum Sponsor for this year’s Advancing Excellence: Global Perspectives on Construction Dispute Resolution Conference, organized by Ciarb Cyprus. The event was held on the 21 & 22 May 2024 and focused on global perspectives about Construction Dispute Resolution (ADR). This event brought together industry leaders, experts, and our own talented team to explore the evolving landscape of ADR and the application of Artificial Intelligence (AI) in construction.

Our Chairman, along with the Head and Director of the Contracts and Claims Department, our BIM expert, and other key employees, participated as panellists and attendees. The conference covered a wide range of crucial topics, including:

1. Digital Transformation in Construction Disputes - Opportunities and Challenges: Exploring how technology is reshaping the resolution of construction disputes and the obstacles we must overcome.
2. ADR Techniques in Construction - Tailoring Solutions for Complex Disputes: Delving into customized ADR approaches to address the unique complexities of construction conflicts.
3. Disputes in a Collaborative World: Understanding how collaboration and communication can prevent and resolve disputes more effectively and aiming to produce a “collaborative” form of contract.
4. An Outbreak of Common Sense - Mediating Construction Disputes: Highlighting the benefits of mediation as a practical and efficient dispute resolution method.
5. Strategic Use of Early or Alternative Dispute Resolution Mechanisms in Construction: Examining the proactive use of ADR techniques to mitigate disputes before they escalate.
6. The Future is Now - Potential Uses for Generative AI in Construction Arbitration and Dispute Prevention: Discussing the transformative potential of AI in arbitration and dispute prevention, while underscoring the urgent need for our company to adopt these technologies.
7. Role of Experts and Specialized Witnesses in Construction Dispute Resolution: Emphasizing the importance of expertise and specialized knowledge in resolving complex construction disputes and stressing the objective and unbiased role of the Expert and overriding duty to assist the court on matters relevant to the expert’s area of expertise.

In addition to these sessions, the conference featured two workshops focused on delay analysis and mediation, which provided our team with practical skills and knowledge.

One of the standout discussions was on the integration of generative AI in construction arbitration and dispute prevention. This innovative technology promises to revolutionize how we approach dispute resolution, offering faster, more accurate, and cost-effective solutions. 

As a company, we must recognize the importance of embracing AI and other technological advancements in all our services to maintain our competitive edge. Having said that, it is important to stress the consensus of most of the participating experts that AI will not replace the role of the various experienced consultants involved in ADR and arbitration (yet!) but using it to our advantage is key.
